Abstract

This research is motivated by regulatory silos and sectoral egos that precipitated a failure in disaster mitigation—exemplified by the disaster that struck Tapanuli in late 2025. The study aims to analyze authority imbalances among agencies and formulate a collaborative reconstruction of administrative law. Employing a normative legal research method—incorporating statutory, case, and conceptual approaches—the study examines the legal system through the lens of Lawrence M. Friedman’s theory. The findings reveal that sectoral egos stem from legal imbalances that exclude regional roles from central licensing processes, fragmented institutional structures, and a bureaucratic legal culture that disregards coordination. As a solution, the study proposes a collaborative governance model that integrates binding recommendations from local governments into central licensing procedures. This transformation is intended not only to resolve conflicts of authority but also to serve as a strategic step toward establishing a system of governance that is both effective and disaster-resilient.
